Copyright Infringement Notice

Arvudek respects the intellectual property rights of others and expects users of our services to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act and other applicable intellectual property laws.

Filing a DMCA Notice

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our platform, you may notify our designated copyright agent by providing the following information in writing:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity, including information reasonably sufficient to permit us to locate the material
  • Your contact information, including your address, telephone number, and email address
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with our copyright agent. Your counter-notification must include:

  • Your physical or electronic signature
  • Identification of the material that has been removed or disabled and the location where it appeared before removal
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, telephone number, and email address
  • A statement that you consent to the jurisdiction of the federal court in your location, or if you are outside the applicable jurisdiction, any judicial district in which we may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person

Repeat Infringer Policy

In accordance with applicable law and under appropriate circumstances, we will terminate the accounts of users who are repeat infringers or are repeatedly charged with infringement.

Processing Time

Upon receipt of a valid DMCA notice, we will remove or disable access to the allegedly infringing material expeditiously. We will notify the user who posted the material that we have removed or disabled access to the material.

If we receive a valid counter-notification, we will forward it to the party who submitted the original DMCA notice. If the original complainant does not file a court action seeking an order to restrain the user from engaging in infringing activity, we may replace or restore access to the material within 10 to 14 business days after receiving the counter-notification.

Misrepresentation

Please note that under applicable law, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability.

Educational Content

Our platform provides educational content related to macro photography. All original content created by Arvudek is protected by copyright. Users who upload content to our platform retain their copyright ownership but grant us a license to display and distribute such content as part of our services.

Fair Use

We recognize that certain uses of copyrighted material may constitute fair use under copyright law. Before filing a DMCA notice, please consider whether the use in question might be protected as fair use. Fair use is a legal doctrine that permits limited use of copyrighted material without requiring permission from the rights holders.
